Agreement to Terms These Terms of Service (“Terms”) govern your use of the Yamaha Outboard Specialist website (the “Site”) and your relationship with Yamaha Outboard Specialist (“Company,” “we,” “us,” “our”). By using our Site, requesting service, submitting a form, calling, emailing, or texting us, you agree to these Terms. If you do not agree, do not use the Site or our services.
Services, Information, and Estimates We provide Yamaha outboard diagnostics, maintenance, and repair services (the “Services”). Information on the Site is for general informational purposes and may change at any time. Any quote, estimate, schedule, turnaround time, or availability provided by phone, text, email, or through the Site is an estimate only and may change based on inspection results, parts availability, workload, seasonality, weather, access to the vessel, and other factors outside our control.
Service Requests and Customer Responsibilities When requesting service, you agree to provide accurate contact information and accurate details about your engine and symptoms. You are responsible for providing safe access to the vessel/engine (if service is performed at a location), ensuring the vessel is secured, providing keys/permission as needed, and disclosing any known hazards or prior issues. If you bring equipment or a vessel to us, you are responsible for transporting it safely and lawfully.
Diagnostics, Authorization, and Approvals Many issues require diagnostics before an accurate repair plan and price can be confirmed. You authorize us to perform diagnostics as requested/approved. After diagnostics, we will communicate findings and recommended repairs when practical, and we will seek your approval before proceeding with additional work beyond the approved scope. You may be responsible for diagnostic time/fees even if you decline repairs, to the extent permitted by law and as disclosed during scheduling.
Parts, Availability, and Substitutions Repairs may require parts that can be delayed due to supplier availability or shipping. When appropriate, we may use OEM parts or high-quality equivalent parts based on availability, compatibility, and your preferences where feasible. You agree that parts availability may impact timelines and final pricing.
Scheduling, Delays, and Abandoned Property Appointment windows and completion dates are not guaranteed. Delays may occur due to workload, parts, weather, access constraints, or unforeseen conditions discovered during service. If applicable and permitted by law, items left beyond a reasonable pickup window after notice may be subject to storage fees and/or treated as abandoned property in accordance with Florida law.
Payments, Deposits, and Fees Unless otherwise agreed in writing, payment may be required to schedule service, order parts, or release the vessel/equipment. We may require a deposit for parts or larger jobs. Unpaid balances may result in delays, suspension of work, or refusal to release equipment where permitted by law. You are responsible for any applicable taxes and third-party processing fees, if any, as disclosed at payment time.
Cancellations and Rescheduling You may request to reschedule based on availability. If you cancel with short notice, miss an appointment, or we have already ordered or reserved parts/time for your job, you may be charged a cancellation fee or billed for time/expenses incurred where permitted by law. Any deposits or prepayments may be non-refundable to the extent they cover ordered parts, special orders, or time already spent.
Risk of Loss, Damage, and Limitation of Responsibility Marine service involves risks, including corrosion, seized components, hidden damage, prior improper repairs, and water exposure. You acknowledge that some failures may be intermittent or may require additional diagnostics over time. To the fullest extent permitted by law, we are not responsible for pre-existing conditions, normal wear, corrosion-related breakage during disassembly, or issues caused by misuse, improper fuel, lack of maintenance, contamination, or conditions outside our control.
Warranties and Disclaimers To the fullest extent permitted by law, the Site and Services are provided “as is” and “as available.” We do not guarantee uninterrupted access to the Site or that the Site will be error-free. We do not guarantee specific outcomes, performance gains, or that a repair will prevent future failures. Any warranty on parts may be provided by the manufacturer. Any labor warranty, if offered, will be disclosed to you in writing or at the time of service; otherwise, no additional warranty is provided beyond what is required by law.
Limitation of Liability To the fullest extent permitted by law, Yamaha Outboard Specialist will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of use, loss of profits, towing costs, docking fees, travel expenses, or missed trips. Our total liability for any claim related to the Site or Services will not exceed the amount you paid us for the specific Services giving rise to the claim.
Communications Consent (Calls, Email, SMS) — A2P/TCPA By providing your contact information (including your phone number), you agree that we may contact you by phone call, voicemail, email, and text message for service-related purposes, including scheduling, confirmations and reminders, diagnostic updates, approvals, parts updates, invoices/receipts, and customer support responses. Consent to receive text messages is not required to purchase goods or services, but certain service-related messages may be necessary to fulfill requests you initiate.
